Please read these Terms of Service ("Terms") carefully before using the Services operated by UpcharMitra Pvt. Ltd.("UpcharMitra", "we", "us", or "our"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading the LocalPill application, or otherwise accessing our Services, you confirm that you are at least 18 years of age and agree to these Terms and our Privacy Policy. If you do not agree, you may not use our Services.

2. Description of Services

UpcharMitra operates technology platforms including LocalPill, which connects patients with nearby pharmacies for medicine availability enquiries. UpcharMitra is a technology intermediary and does not itself sell, dispense, or deliver medicines. All transactions for medicines occur directly between patients and pharmacies.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must provide accurate and complete information when creating an account.
• You must notify us immediately at [email protected] if you suspect unauthorised use of your account.
• You may not create accounts on behalf of another person without their explicit consent.

4. Pharmacy Partner Terms

• Pharmacies must hold a valid drug license and all necessary regulatory approvals under the Drugs and Cosmetics Act, 1940, and applicable state laws.
• Pharmacies are solely responsible for the accuracy of medicine availability information they provide and for all transactions with patients.
• UpcharMitra reserves the right to verify pharmacy credentials and suspend or remove any pharmacy found to be providing false information.
• Subscription fees (if applicable) are non-refundable except as expressly stated in the relevant subscription agreement.

5. Prohibited Conduct

You agree not to:

• Use our Services for any unlawful purpose or in violation of applicable laws
• List controlled substances, Schedule H/H1 drugs, or any restricted medicines without proper authorisation
• Harass, abuse, or harm other users or pharmacy partners
• Attempt to reverse-engineer, scrape, or disrupt our platform or infrastructure
• Create fake accounts or misrepresent your identity
• Use our Services to spread misinformation about medicines or healthcare

6. Intellectual Property

All content, trademarks, logos, and software on our Services are the property of UpcharMitra Pvt. Ltd. or its licensors. You may not copy, modify, distribute, or use any of our intellectual property without prior written permission.

7. Disclaimers

UpcharMitra is a technology intermediary. We do not provide medical advice, diagnosis, or treatment. Information on our platform is for convenience only and does not constitute a recommendation to purchase any medicine. Always consult a qualified healthcare professional for medical advice.

Our Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.

8. Limitation of Liability

To the maximum extent permitted by applicable law, UpcharMitra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use our Services.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Patna, Bihar, India. We encourage resolution through amicable discussion before initiating legal proceedings.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the effective date. Continued use of our Services after changes constitutes acceptance of the revised Terms.
